Terms of Service
These Terms of Service (hereinafter referred to as these "Terms") govern the purchase of raffle tickets for the 2026 EPIC E40FX golf cart (hereinafter referred to as the "Cart") conducted by Lake Dunlap Area Volunteer Fire Department (hereinafter referred to as "LDVFD"). By purchasing a ticket, the purchaser agrees to be bound by these Terms.
1. Authority to Conduct This Raffle
LDVFD is a qualified volunteer fire department authorized to conduct charitable raffles under the Texas Charitable Raffle Enabling Act, Texas Occupations Code Chapter 2002, and is a federally recognized tax-exempt organization under Section 501(c)(3) of the Internal Revenue Code (EIN: 74-2801490).
2. Purchasing Tickets
A maximum of 1,750 tickets shall be sold for this raffle. Tickets may be purchased online through this website, or in person at LDVFD-organized events (see LDVFD's Facebook page for event dates and locations). The price per ticket is $50.00 when purchased in person by cash or check, and $51.50 when purchased online or in person by card (reflecting a 3% card processing fee). Multiple tickets may be purchased in a single online order. All tickets included in a single order will be mailed together in one shipment. Multiple separate orders placed online using the same shipping address will also be grouped and mailed together where possible. Only members of LDVFD are authorized to sell tickets on its behalf.
3. Eligibility to Purchase
Purchasers must be at least 18 years of age. LDVFD reserves the right to request proof of age prior to completing a sale.
4. The Drawing
The drawing to determine the winner of the Cart (hereinafter referred to as the "Drawing") shall be held on June 22, 2027, at the Lake Dunlap Fire Department, or as soon as all 1,750 tickets have been sold, whichever occurs first. The winner shall be selected at random from among all valid tickets sold. The winner need not be present at the Drawing to win. If all tickets sell out prior to June 22, 2027, LDVFD will confirm the resulting Drawing date and announce it across all available Department information channels, including but not limited to LDVFD's Facebook page, LDVFD's website, and this website, no fewer than seven (7) days prior to the confirmed Drawing date.
5. The Prize
The Cart shall be awarded to the winning ticket holder. No cash prize, cash equivalent, or cash refund of any ticket's purchase price shall be substituted for the Cart under any circumstance. The Cart is street legal under the City of New Braunfels' golf cart ordinance, built to meet the equipment standards required for operation on permitted city streets within New Braunfels. This designation is specific to jurisdictions that have adopted a comparable local ordinance under Texas Transportation Code Chapter 551; it is the winner's sole responsibility to verify and meet any registration, license plate, insurance, or equipment requirements applicable in the winner's own jurisdiction prior to operating the Cart on public roads. The winner is solely responsible for all fees, taxes, and registration steps required under applicable state or local law in connection with receiving the Cart, and LDVFD will not release or transfer possession of the Cart to the winner until the winner has provided confirmation that all such requirements have been satisfied. The winner shall have thirty (30) days from the date of the Drawing to satisfy this requirement and claim the Cart.
6. Tax Treatment
Ticket purchases are not charitable contributions and are not tax-deductible. Under IRS guidance, a purchaser who buys a ticket for a chance to win a prize receives full consideration in exchange for the purchase price, regardless of the value of the prize or the purchaser's odds of winning. No portion of any ticket price may be claimed as a tax-deductible donation.
7. Refunds
Refunds are issued only under the circumstances and in the manner described in LDVFD's Refund Policy. All other ticket sales are final.
8. Information We Collect
In connection with the sale of tickets, LDVFD collects the purchaser's name, mailing address, and phone number for the purpose of fulfilling and delivering the ticket stub. For online purchases, payment card information is collected and processed directly by Shopify Payments; LDVFD does not store or have access to full payment card numbers. For in-person purchases, purchaser information is recorded by LDVFD members using internal organizational records. LDVFD does not sell purchaser information to any third party. This section addresses information specific to the raffle; general website data practices are governed by LDVFD's Privacy Policy.
9. Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes arising under these Terms shall be venued in Guadalupe County, Texas.
Changes to This Policy
LDVFD reserves the right to modify, update, or amend these Terms at any time without prior notice. Continued participation in the raffle following any such modification constitutes acceptance of the revised Terms as posted.
